A borrower has been let off repaying her £8,000 debts in a case that could pave the way for thousands of borrowers trying to escape repayments . Mrs Lynne Thorius had £8,000 of debts on her credit card, which the MBNA credit card company were trying to force her to repay. However, Judge Jacqueline Smart at South Shields county court ordered the company could not demand she repaid her debts as there had been an unfair relationship between Mrs Thorius and the lender because she had been missold payment protection insurance .
Mrs Thorius used claims management firm Cartel Client Review, who lauded the case as a significant landmark for consumers in similar situations. Carl Wright from Cartel Client Review said the case would have ‘massive ramifications’, meaning consumers could escape from millions of pounds of debts, whether in the form of credit cards or personal loans .
MBNA played down the significant of the case, however, pointing out that county court cases are decided on their own merits. The company insist that the case doesn’t set a legal precedent as this case went in the borrower’s favour because the appropriate documents had not been provided to the customer.
